1. Who you are buying from

These terms govern the sale of the pieces offered on this website by José Miguel Aparicio Santos, NIF 51385127E, address Calle San Benito 4, 4º C, 28029 Madrid, Spain, email jmapa64@hotmail.com. Placing an order implies acceptance of these terms.

2. The pieces

Every piece sold here is sculpted and painted by hand. The originals are modelled in clay, moulded in silicone and cast in polyurethane resin; each copy is then retouched and painted individually in acrylics.

As a consequence, no two copies are strictly identical. Small variations in tone, finish and detail between the piece you receive and the photographs shown are inherent to the technique and are not considered defects.

Figures in the 1:35 range are supplied unpainted and lightly sanded, as described on each product page.

3. Made to order and production time

Pieces are not held in stock: each one is cast, finished and painted after your order is placed.

The usual production time is approximately 15 days from confirmation of payment. Shipping time is added on top of that and depends on the destination. Where a piece requires longer — because of its size or complexity — you will be informed by email before production begins.

These periods are estimates made in good faith and may vary. If a significant delay arises you will be told promptly, and you may cancel the order and obtain a full refund.

4. Prices and taxes

Prices are shown in euros (€). Prices are final prices and include any applicable VAT (IVA). Shipping costs are shown separately during checkout, before you confirm the order.

For deliveries outside the European Union, any customs duties, import taxes or clearance fees are payable by the buyer and are not included in the price or the shipping cost.

5. Placing an order

Select the piece, add it to the basket and complete the checkout process. You will receive an email confirming receipt of the order; the contract is formed when that confirmation is sent. If any detail is wrong, contact us as soon as possible and before production begins.

6. Payment

Accepted payment methods are those shown during checkout. Payment data is processed directly by the payment provider and is never stored on this website.

7. Shipping and delivery

Orders are shipped to the address given at checkout. Costs and available destinations are shown before you confirm the order.

Pieces are fragile and are packed accordingly. On receipt, please check the parcel: if the outer packaging shows damage, note it on the carrier’s delivery document and tell us within 24 hours, attaching photographs of the packaging and the piece. This makes any claim considerably easier.

8. Right of withdrawal

If you are a consumer, you have 14 calendar days from receipt of the piece to withdraw from the purchase without giving any reason, by writing to jmapa64@hotmail.com.

The piece must be returned complete and undamaged, in its original packaging, within 14 days of notifying the withdrawal. The cost of return shipping is payable by the buyer. Once the piece has been received and checked, the amount paid is refunded within 14 days using the same payment method.

Exception. In accordance with Article 103(c) of Spanish Royal Legislative Decree 1/2007, the right of withdrawal does not apply to pieces made to the buyer’s specifications or clearly personalised — that is, commissions and custom work. This exception does not affect catalogue pieces, which remain subject to the 14-day right even though they are produced after ordering.

9. Legal guarantee

Pieces are covered by the legal guarantee of conformity of three years from delivery, under Spanish consumer law. This guarantee covers manufacturing defects. It does not cover damage caused by misuse, accidental breakage after delivery, or the normal variation between hand-painted copies described in section 2.

10. Complaints and dispute resolution

Complaints may be sent to jmapa64@hotmail.com and will be answered as soon as possible.

11. Applicable law

These terms are governed by Spanish law. Nothing here limits the rights that consumer protection legislation grants you in your country of residence within the European Union.
